Modification/Termination
Child support may be modified, higher or lower, if there has been a substantial change in circumstances since the entry of the child support judgment or order. If the person paying support has lost his/her job through no fault of their own, or if the other parent who is receiving support has increased his/her income, or if the daycare expenses or other factors that are included in the child support calculation have changed, child support may sometimes be changed.
Additionally, child support typically terminates when the child reaches the age of 18, unless the child is still in high school, in which case it may continue through the graduation from high school if certain factors are present. If your child support order/judgment does not state on what date child support stops for a child, then a petition seeking the Court to determine when the child support stops should be filed prior to the child’s 18th birthday.
