Same Sex/Gay Marriage
In 2014, a United States District Court Judge in Florida struck down as unconstutional Florida’s statutory and constitutional bans on same-sex marriage, and in January 2015, same-sex couples were allowed to get married in Florida for the first time. The struggle to attain marriage equality has been a long one, but same-sex couples have now achieved that goal in Florida. The case which decided this in Florida is, however, on appeal to the Eleventh Circuit Court of Appeal. Further, the United States Supreme Court is going to hear four same-sex marriage cases from other states, in April 2015. So the laws on this issue are still in a constant state of flux.
If you are in a same-sex relationship, even if you have now been married, if you previously had children, you may still need to take actions to make sure that both partners in the relationship have full parental rights regarding the children. And if you have had children and you do not plan to get married, then you certainly need to take actions to protect your rights as parents. And even if you have now been married, like any other married couple, there are estate planning issues which you need to consider.
