Time Periods for Hearings?


The statute provides that the Court shall schedule a hearing on whether a parent may relocate temporarily, pending a final determination, within 30 day after a motion for temporary relocation is filed (absent good cause),  and a final hearing on the petition within 90 day of the filing of the petition (absent good cause).

If you want to relocate with your child or children you must act as quickly as possible prior to the time you wish to move.  Or, if the parent of your child or children is seeking to move, you must begin to prepare for the relocation hearing quickly, as the hearing could be scheduled more quickly than other types of family law matters.  Either way, it is important to have an experienced attorney on your side.
